1. Introduction

E-LICHIDARE.RO processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Law no. 190/2018 on measures implementing the GDPR. This policy describes what data we collect, how we use it and how we protect it.

2. Data controller

3. Data collected

Data provided by users:

  • On registration: name, email, phone, user type (insolvency practitioner, enforcement agent, bank, buyer)
  • When publishing listings: information about assets, prices, contact details
  • When sending messages: the content of messages between users

Data collected automatically:

  • IP address, browser type, pages visited
  • Session cookies (necessary for the operation of the website)

4. Legal basis and purpose of processing

  • Performance of the service and of the relationship with registered users (Article 6(1)(b) GDPR);
  • The legitimate interest in operating and improving the Platform (Article 6(1)(f) GDPR);
  • Consent, for non-essential cookies (Article 6(1)(a) GDPR);
  • Compliance with legal obligations (Article 6(1)(c) GDPR).

5. Disclosure of data

We do not sell users' personal data. The following technical transfers may be necessary for the operation of the Platform:

  • Hosting provider: storage of data on servers located in the European Union.
  • Recipients' email servers: when you contact an insolvency practitioner, enforcement agent or bank, the data in your message is processed by the recipient's email provider.
  • Competent authorities: personal data may be disclosed at the express request of the authorities, in accordance with applicable law.

6. Public data

The Platform aggregates public data from official sources (REPES, ANAF e-Auctions, UNPIR, bank announcements). This data comes from publications of a public nature, with the original source preserved.

6.1. GDPR information for debtors (data from public procedures)

Listings imported from official sources may contain the name of the debtor entity. We apply the principle of data minimisation (Article 5(1)(c) GDPR):

  • We display only the data necessary to identify the asset and the listing; we do not publish the debtor's tax identifier (CUI/IDNO) on the public page or in the structured data.
  • For each listing we keep and display a link to the official source, so that the information is verifiable at its origin.
  • The legal basis for processing is the legitimate interest in informing the market (Article 6(1)(f) GDPR), with respect for the rights of the data subject.

How to request erasure / rectification: if you are the data subject (or their representative) and wish to obtain the erasure, rectification or restriction of data in a listing, send a request to office@e-lichidare.ro, indicating the link to the listing. We resolve requests within the legal time limit (as a rule, 30 days). Note: erasure from the Platform does not affect the publication in the original official source, which has its own legal regime.

7. Data security

We use technical and organisational measures to protect data: encrypted connection (SSL/TLS), hashed passwords, restricted access to the database.

8. Cookies

The Platform uses:

  • Essential cookies: session, authentication, language preferences. Necessary for the operation of the Platform.
  • Analytics cookies (optional): they help us understand how the Platform is used. They are activated only with your consent and can be refused from your browser settings.

We do NOT use advertising cookies (re-targeting / ad personalisation).

9. Rights of the data subject (GDPR)

Under the GDPR, you have the right to: request access to your data, its rectification or erasure, the restriction of or objection to processing, data portability and the withdrawal of consent. You also have the right to lodge a complaint with the ANSPDCP (the National Supervisory Authority for Personal Data Processing (ANSPDCP), www.dataprotection.ro).
