What is insolvency?
Insolvency is the situation in which a company can no longer pay its debts. Creditors ask the court to open the procedure under Law no. 85/2014. The court appoints an insolvency practitioner who takes over control.
How are the assets sold?
The assets are sold through public auction. The insolvency practitioner publishes the notice in the Insolvency Proceedings Bulletin (BPI) and sets the starting price. If no one takes part, the auction is repeated at a reduced price (10-25%).
Why are the prices attractive?
The main goal is not the market price but the recovery of claims. Combined with the limited interest, final prices end up 30-70% below market. See examples in the real estate at auction category.
